Source of Income Discrimination

Also called: Voucher Discrimination, No Section 8

What it means

Refusing to rent to someone because of how they pay — including Section 8 vouchers, VASH vouchers, FHEPS, or any other lawful source of income. In New York, source of income is a protected category under the Human Rights Law. A landlord cannot say 'no Section 8' or 'no vouchers.' A landlord cannot advertise that they do not accept vouchers. Violating this law can result in a complaint to the Division of Human Rights or HUD, and the landlord may owe damages.

When you might hear this

You hear this when a landlord refuses to rent to someone because they plan to pay with a Section 8 voucher, VASH voucher, or other government rental assistance. In New York, this is illegal.

What to ask

  • Did the landlord say they do not accept vouchers or government assistance?
  • Was the refusal in writing, by text, or verbal?
  • Is there a witness or a recording of the refusal?
  • Has a complaint been filed with DHR or HUD?
